Short answer: today, yes — THCa flower that tests under 0.3% Δ9 THC is federally legal hemp. Longer answer: several states restrict it, and a federal change on November 12 ends the category nationally. This guide walks through all three layers.
Federal law today
The 2018 Farm Bill defines hemp by Δ9 THC content only: no more than 0.3% on a dry-weight basis. THCa is a different molecule and is not counted. High-THCa flower that tests under the Δ9 limit is hemp, and hemp is legal to sell and ship across state lines.
The key phrase is "at the time of testing." THCa converts to THC when heated, so the flower you buy as hemp delivers a full THC experience once smoked. That is the loophole — and it is the reason the law is changing.
Federal law after November 12

State law
States can be stricter than federal law, and several are. Some states already use a total-THC definition, some ban smokable hemp outright, and some have moved THCa specifically onto their controlled-substance schedules. Per state guidelines, JGO does not ship THCa flower to Arkansas, Idaho, Minnesota, Oregon, or Rhode Island. Other states (Texas and Tennessee among them, following 2025 regulatory actions) have restrictions that change quickly — check your state before ordering.
